I tease out two early Christian puzzles about agency: (a) agential control: how can agents self-constitute if their primary experience of themselves is not one of control, as in Greek antiquity, but of relative powerlessness? And (b) ethical expertise: how can agents constitute themselves as ethical agents if they cannot trust themselves to recognize, and act in the light of, the good? I argue, first, that Foucault saw the importance of these puzzles and focused on extreme obedience as affording a (...) possible resolution; second, that he failed to resolve the puzzles because of his reliance on an overly voluntarist and reflective understanding of obedience as an exercise of will; and finally, that turning to Cassian’s own thoughts on the relation between extreme obedience and humility as kenosis affords us a way out of the puzzles. W.V. Quine and Ludwig Wittgenstein have been compared with regard to the analytic/synthetic distinction, propositions known a priori or a posteriori, mathematical and logical necessity and naturalism, amongst other topics. Following Pieranna Garavaso and Danièle Moyal-Sharrock, I compare how Quine and Wittgenstein conceptualize a system of beliefs. Overlooked is Wittgenstein's description of the role of propositions and Quine's description of the location of propositions. The difference between the role and location signals a difference in how these frameworks conceptualize the boundary (...) between empirical and logical propositions, and in particular the justificatory status of propositions in the system. The Wittgensteinian framework accommodates a change in the justificatory status of propositions: propositions can play at one time a rule-like role and at another time an empirical role. For Quine, change in status refers to revising the proposition (or not) in the light of recalcitrant evidence. (shrink)

This paper looks at the attribution of the ability to lie and not at lying or lies. It also departs from more familiar approaches by focussing on the appraisal of an ability and not on the ability in itself. We believe that this attribution perspective is required to bring out the cognitive and intentional basis of the ability to lie.

Recent philosophical literature on epistemic harms has paid little attention to the difference between deliberate and non-deliberate harms. In this paper, I analyze the “Curare Case,” a case from the 1940’s in which patient testimony was disregarded by physicians. This case has been described as an instance of epistemic injustice. I problematize this description, arguing instead that the case shows an instance of “epistemic disadvantage.” I propose epistemic disadvantage indicates when harms result from warranted asymmetric relations that justifiably exclude individuals (...) from hermeneutical participation. Epistemic disadvantage categorizes harms that result from justifiable exclusions, are non-deliberate, and result from poor epistemic environments. This analysis brings out a meaningful difference between accidental and deliberate harms in communicative exchanges. (shrink)

Analytic philosophy has recently demonstrated a revived interest in metaphysical problems about possibility and necessity. Graeme Forbes here provides a careful description of the logical background of recent work in this area for those who may be unfamiliar with it, moving on to d discuss the distinction between modality de re and modality de dicto and the ontological commitments of possible worlds semantics. In addition, Forbes offers a unified theory of the essential properties of sets, organisms, artefacts, substances, (...) and events, based on the doctrine that identity facts must be intrinsically grounded, and analyzes and rejects apparent counterexamples to this doctrine. A verb is transitive iff it usually occurs with a direct object, and in such occurrences it is said to occur transitively . Thus ‘ate’ occurs transitively in ‘I ate the meat and left the vegetables’, but not in ‘I ate then left’ (perhaps it is not the same verb ‘left’ in these two examples, but it seems to be the same ‘ate’). A verb is intensional if the verb phrase (VP) it forms with its complement is anomalous in at (...) least one of three ways: (i) interchanging expressions in the complement referring to the same entity can change the truth-value of the sentence embedding the VP; (ii) the VP admits of a special “unspecific” reading if it contains a quantifier, or a certain type of quantifier; and (iii) the normal existential commitments of names and existential quantifiers in the complement are suspended even when the embedding sentence is negation-free. There are striking structural similarities between Freud's ego and Kant's transcendental unity of apperception, which for Kant grounds our use of ‘I’ in ‘I think’. There are also striking similarities between Freud's superego and Kant's account of the mental structure that grounds our use of ‘I’ in the moral ‘I ought to’. The paper explores these similarities on three main points: the conflict of motivations internal to the mind, the relation between discursive and pre‐discursive representation of moral motivation, and the (...) unconscious character of moral motivation. The suggestion is that Freud offers resources for a naturalized account of just those features of our moral motivation that, according to Kant, seem to make it least amenable to a naturalistic explanation. How much of a revision of Kant's analysis of moral justification is thereby entailed is beyond the purview of the paper. (shrink)

Growing-Block theorists hold that past and present things are real, while future things do not yet exist. This generates a puzzle: how can Growing-Block theorists explain the fact that some sentences about the future appear to be true? Briggs and Forbes develop a modal ersatzist framework, on which the concrete actual world is associated with a branching-time structure of ersatz possible worlds. They then show how this branching structure might be used to determine the truth values of future contingents. (...) They point out three different ways of interpreting the logical connectives, which give rise to three different logics of the open future: one supervaluationist, one corresponding to Lukasiewicz's strong Kleene logic, and one intuitionist. In this critical review I discuss the main themes of the papers in Kit Fine's Modality and Tense: Philosophical Papers. These themes are that modal operators are intelligible in their own right and that actualist quantifiers are to be taken as basic with respect to possibilist quantifiers. I also discuss a previously unpublished paper of Fine's on modality and existence.

The term 'essentialism' in its popular usage is usually qualified in some way, as in 'biological essentialism', 'gender essentialism' and 'social essentialism'. The essentialist theses were defended on the grounds that denying them leads, under plausible assumptions, to pairs of worlds containing objects which are intrinsic and spatio‐temporal duplicates and yet which are numerically distinct. This chapter outlines some technical difficulties in getting the definitions of 'essential property' and 'individual essence' exactly right. It explains the idea of a metaphysically essential (...) property in terms of Aristotle's 'essential/accidental' contrast. A popular idea is to invoke the notion, which has its roots in Aristotle's theory of essence and accident, of a substance sortal. A different way of developing a sortal‐based account of essential kinds is suggested by David Wiggins, who argues that it is only ultimate sortals that represent essential properties, where an ultimate sortal is the most general sortal corresponding to a given principle of individuation. [Graeme Forbes] In I, I summarize the semantics for the relational/notional distinction for intensional transitives developed in Forbes (2000b). In II-V I pursue issues about logical consequence which were either unsatisfactorily dealt with in that paper or, more often, not raised at all. I argue that weakening inferences, such as 'Perseus seeks a mortal gorgon, therefore Perseus seeks a gorgon', are valid, but that disjunction inferences, such as 'Perseus seeks a mortal gorgon, therefore Perseus seeks a mortal gorgon (...) or an immortal gorgon', are invalid. Since 'a gorgon' and 'a mortal gorgon or an immortal gorgon' are extensionally and intensionally the same quantifier, it is not completely trivial to arrange the semantics of intensional transitives so that this classification of the inferences is obtained. In particular, I ask which verbs Forbes should take to be intensional transitives. I argue that it is very difficult to arrive at a clear and plausible understanding of what an intensional transitive is-making it difficult to answer these questions. Up to the present, there have not been any specific norms regarding medically assisted human reproduction in Romanian legislation. Due to this situation the general legislation regarding medical assistance, the Penal and Civil law and the provisions of the Code of Deontology of the Romanian College of Physicians are applied to the field of medically assisted human reproduction. By analysing the ethical and legal conflicts regarding medically assisted human reproduction in Romania, some characteristics cannot be set apart because they derive (...) from religious, cultural and socio-economic aspects. In this article the authors identify the development stages of medically assisted human reproduction in Romania, beginning from these characteristics and insisting upon the failure of the legal system in this specific field. The authors consider that the law regarding medically assisted human reproduction cannot be effective because it did not take into account the ethical and cultural aspects that might appear. Furthermore, in this framework of the legal process, no public debate involving the representatives of civil society was undertaken although the Council of Europe Oviedo Convention approved by our country according to law no. 17/2001 stipulated exactly this working method.
